Medical malpractice

Medical malpractice is more common than many Americans would like to believe. According to recent studies, more than 98,000 Americans die or are seriously injured each year as a result of medical malpractice in hospitals alone. Malpractice can consist of many things, including: Failing to properly diagnose a disease or condition; Failing to take appropriate steps to treat a condition; Negligently performing treatment or surgery to treat the condition; Failing to properly advise the patient of risks associated with a particular treatment; Performing treatment or surgery which was not authorized by the patient

Under Florida law, a bad result from a procedure does not necessarily mean that the doctor is guilty of malpractice because doctors are not required to guarantee the results of their treatment. On the other hand, every doctor is required to perform medical services with reasonable competence and within proper standards of care recognized for physicians in his or her field of expertise. Failure to provide medical services in this manner is malpractice.
